Detection of cartel activity continues to rise as the fight against cartels remains high on the agenda of competition regulators around the world. Imposition of record fines in a number of sectors including the air cargo sector has made recent headlines. Also notable has been the exercise of extra-territorial reach of the United States Department of Justice in the Norris case.
Corporate compliance must now keep pace with a very globalised cartel enforcement effort. Companies not only face aggressive and co-ordinated multi-jurisdictional investigations as evidenced by the marine hoses and air cargo cases, but also the prospect of financial incentives being offered to its officers by regulators to blow the whistle. The UK OFT now joins the likes North Korea in this last respect. Leniency regimes also provide significant incentives for cartelists to identify collaborators.
Compliance officers conducting internal investigations now have to take into account the possible personal criminal liability of company officers, and issues of data retention and legal privilege. Corporations also need to act quickly to put in place integrated defence strategies to deal with simultaneous investigations, private and class actions in multiple jurisdictions and take steps to minimise fines, damages and above all, adverse publicity.
